TERMS OF USE

Use of ntasys.com confers the status of User of ntasys.com, whether a natural or legal person, and necessarily implies full, unreserved acceptance of each and every one of the clauses and general conditions included in this Legal Notice. If the User does not agree with the clauses and terms of use of this Legal Notice, they must refrain from using ntasys.com. This Legal Notice is subject to changes and updates, so the version published by Ntasys may differ each time the User accesses the Portal. The User must therefore read the Legal Notice every time they access ntasys.com.

Through ntasys.com, Ntasys provides the User with access to and use of various Contents published on the Internet by Ntasys or by authorised third parties.

The User undertakes not to transmit, disseminate or make available to third parties any kind of material contained in ntasys.com, such as information, texts, data, contents, messages, graphics, drawings, sound and/or image files, photographs, recordings, software, logos, trademarks, icons, technology, links, graphic design and source code, or any other material to which they may have access as a User of ntasys.com, this list not being exhaustive. Likewise, in accordance with the foregoing, the User may not:

• Reproduce, copy, distribute, make available or otherwise publicly communicate, transform or modify the Contents, unless they have the express written authorisation of Ntasys, as owner of the corresponding rights, or this is legally permitted.
• Remove, manipulate or in any way alter the “copyright” and other identifying data of the rights reserved by Ntasys or their owners, the fingerprints and/or digital identifiers, watermarks, or any other technical means established for their recognition.

The User must refrain from obtaining, or even attempting to obtain, the Contents by means or procedures other than those that, as the case may be, have been made available for this purpose or indicated for this purpose on the web pages where the Contents are located or, in general, those normally used on the Internet for this purpose, provided that they do not entail a risk of damage to or disabling of ntasys.com and/or the Contents.

INTELLECTUAL PROPERTY

All trademarks, trade names or distinctive signs of any kind appearing on ntasys.com are the property of Ntasys or, where applicable, of their respective owners. Likewise, the Contents are the intellectual property of Ntasys or, where applicable, of third parties; therefore, the Intellectual Property rights belong to Ntasys or to third parties who have authorised their use, to whom the exclusive exercise of the exploitation rights corresponds in any form and, in particular, the rights of reproduction, distribution, public communication and transformation. Unauthorised use of the information contained on this Website, as well as infringement of the Intellectual or Industrial Property rights of Ntasys or of third parties included in ntasys.com who have provided content, will give rise to the legally established liabilities.

AVAILABILITY OF NTASYS.COM

Ntasys does not guarantee that access to ntasys.com and its contents will be free from interruptions or errors, nor that they are up to date, although it will make its best efforts to avoid, remedy or update them, as the case may be. Consequently, Ntasys is not liable for any damage of any kind suffered by the User as a result of failures or disconnections in the telecommunications networks that cause the suspension, cancellation or interruption of the portal’s service during or prior to its provision.

Ntasys excludes, with the exceptions provided for in current legislation, any liability for damage of any nature that may be due to the lack of availability, continuity or quality of the operation of ntasys.com and the Contents, or to the failure to meet the expectations of usefulness that the USER may have attributed to ntasys.com and the Contents.

The sole purpose of the Hyperlinks that appear on this Website is to inform the User of the existence of other Websites containing information on the subject. Said Hyperlinks do not constitute any suggestion or recommendation.

Ntasys is not responsible for the contents of said linked pages, for the operation or usefulness of the Hyperlinks or for the result of said links, nor does it guarantee the absence of viruses or other elements in them that may cause alterations to the computer system (hardware and software), documents or files of the User, excluding any liability for damage of any kind caused to the User for this reason.

Access to ntasys.com does not imply any obligation on the part of Ntasys to check for the absence of viruses, worms or any other harmful computer element. In all cases, it is the User’s responsibility to have suitable tools for detecting and removing harmful computer programs; therefore, Ntasys is not responsible for any security errors that may occur during the provision of the ntasys.com service, nor for any damage that may be caused to the computer system of the User or third parties (hardware and software), or to the files or documents stored on it, as a result of the presence of viruses on the User’s computer used to connect to the services and contents of the Website, a malfunction of the browser or the use of outdated versions of it.

The provision of the ntasys.com service and the Contents is, in principle, of indefinite duration. Ntasys is nevertheless authorised to terminate or suspend the provision of the ntasys.com service and/or any of the Contents at any time. Whenever reasonably possible, Ntasys will give prior notice of the termination or suspension of ntasys.com.

Given the dynamic and changing nature of the information and services provided through ntasys.com, Ntasys makes its best efforts but does not guarantee the complete truthfulness, accuracy, reliability, usefulness and/or timeliness of the Contents. LIMITATION OF LIABILITY

Ntasys excludes all liability for any decisions the User may make based on this information, as well as for any typographical errors that the documents and graphics of ntasys.com may contain. The information is subject to possible periodic changes to its content, without prior notice, due to the expansion, improvement, correction or updating of the Contents.

NOTIFICATIONS

All notifications and communications from Ntasys to the User made by any means shall be deemed effective for all purposes.

JURISDICTION

For any matters arising from the interpretation, application and fulfilment of this Legal Notice, as well as any claims that may arise from its use, all parties involved submit to the Judges and Courts of the province of Madrid, expressly waiving any other jurisdiction that may correspond to them.

APPLICABLE LAW

This Legal Notice is governed by current Spanish law.
